1. Services Provided

Obsidian Studio provides branded business platforms, Shopify implementation, hosted business systems, custom business systems, booking systems, intake systems, upload systems, WhatsApp automation, AI-assisted workflows, landing pages, product pages, and related digital services.

2. Monthly Hosting Requirement

Each implementation package may require a monthly hosted system fee. The Starter package is US$49/month, the Growth package is US$99/month, and the Premium package is US$129/month. Monthly hosting fees are separate from one-time implementation fees unless clearly stated otherwise in writing.

3. Payment Terms

Work begins only after the required checkout, deposit, payment, or approved billing arrangement is completed. Payment confirms that the client authorizes Obsidian Studio to begin implementation based on the selected package.

Prices are listed in United States Dollars unless otherwise stated. Any bank fees, currency conversion fees, payment processor fees, or third-party charges are the responsibility of the client.

4. Implementation Scope

Each build is completed according to the selected package and approved scope. The implementation scope may include design, layout, branding, system structure, page buildout, intake flow, checkout routing, upload structure, WhatsApp routing, AI workflow planning, Booking Core™ setup, or backend planning depending on the selected package.

Additional features, new sections, new pages, advanced automation, backend changes, custom database work, extra upload logic, or redesign requests may require additional payment.

5. Branding

All implementation packages include branding. Obsidian Studio may apply the client’s business logo, brand colors, business name, service details, product details, and branded visual direction based on the selected package. Even Starter packages receive a branded platform and branded pop-up flow.

6. Client Responsibilities

The client is responsible for providing accurate business information, logo files, images, written content, services, pricing, product details, contact information, policies, and approval instructions. Delays in providing required information may delay the project timeline.

7. Revisions

Reasonable revisions may be included based on the selected package. Revisions must remain within the original project scope. A new design direction, new business model, major restructuring, or full redesign after implementation has started may require additional payment.

8. Project Timeline

Timelines depend on project complexity, client response time, content delivery, platform access, third-party tools, and the selected implementation package. Exact delivery times are not guaranteed unless confirmed in writing.

9. Hosted Systems

Hosted systems remain active while the client’s monthly payment is current. If monthly payments are missed, the system may be paused, restricted, locked, or removed after the applicable grace period.

10. Booking Core™

Booking Core™ is included in the Growth and Premium implementation packages only. Booking Core™ may include appointment flow, intake forms, customer details, date selection, service selection, upload options, WhatsApp routing, and business notification logic depending on the approved scope.

11. WhatsApp Automation

Some systems may include WhatsApp routing or WhatsApp-based inquiry submission. WhatsApp automation depends on device behavior, browser settings, WhatsApp availability, file size limits, user permissions, and third-party platform restrictions.

12. Online Payment Integration

Online payment integration is not included in the Starter package. Growth includes one online payment integration. Premium includes online payment integration based on the approved scope. Payment gateway approval, account setup, processor rules, and banking requirements remain the client’s responsibility.

13. File Uploads

File upload and video upload features are not included in the Starter package. Growth includes 3 file uploads and 1 video upload. Premium includes upload support based on the approved scope. Upload functionality depends on file size, file type, browser behavior, storage limits, backend setup, Supabase storage, Shopify limitations, and third-party platform rules.

14. AI Features

AI assistant and AI automation features are not included in the Starter or Growth packages. Premium may include an AI business assistant, AI field assistant, AI-powered guidance, or AI automation planning based on the approved scope. AI responses are provided for guidance only and should not be treated as legal, financial, medical, or professional advice.

15. Supabase Backend

Some systems may use Supabase for secure backend storage, form submissions, upload handling, booking data, lead management, or AI workflow data. Supabase backend setup is based on the approved package and project scope.

16. Ownership & Usage Rights

Ownership and usage rights depend on the selected package, payment completion, and whether the project is a hosted system, custom system, digital product, or implementation service. Hosted systems may remain connected to Obsidian Studio infrastructure.

17. Intellectual Property

Obsidian Studio retains ownership of reusable frameworks, internal methods, templates, automation structures, system logic, and proprietary implementation processes unless otherwise agreed in writing. Client-provided logos, brand assets, product images, and business information remain the property of the client or rightful owner.

18. Refund Policy

Digital work, implementation services, custom builds, system setup, strategy work, and started projects may be non-refundable once work has begun. Refund eligibility is reviewed based on project status, work completed, digital delivery, time spent, and the Commercial Terms & Refund Policy.

19. Cancellation

A client may request cancellation, but cancellation does not automatically qualify for a refund. If work has started, completed work, planning time, implementation time, digital setup, and administrative costs may be deducted from any eligible refund.

20. No Guarantee of Sales

Obsidian Studio builds systems designed to improve presentation, lead capture, automation, booking flow, and customer communication. Obsidian Studio does not guarantee sales, revenue, traffic, ranking, profit, or customer results.

21. Third-Party Platforms

Systems may depend on Shopify, Supabase, WhatsApp, email providers, payment processors, domains, browsers, mobile devices, or other third-party services. Obsidian Studio is not responsible for third-party service changes, downtime, policy changes, outages, account restrictions, or limitations.

22. Support

Support depends on the selected package or monthly hosted plan. Support may include guidance, minor updates, troubleshooting, or system assistance. Support does not include unlimited redesigns, new feature development, major platform changes, or unrelated business services unless agreed separately.

23. Prohibited Use

Clients may not use Obsidian Studio systems for unlawful activity, fraud, misleading claims, harmful content, unauthorized data collection, spam, abusive behavior, or any activity that violates applicable laws or platform rules.

24. Limitation of Liability

Obsidian Studio is not liable for indirect losses, lost profits, lost revenue, lost data, platform downtime, payment gateway failures, Shopify issues, Supabase issues, WhatsApp limitations, domain issues, browser problems, or third-party service failures.

25. Changes to Terms

Obsidian Studio may update these Terms & Conditions at any time. Continued use of the website, systems, services, or hosted products after changes are posted means you accept the updated terms.
